TERMS & CONDITIONS

By accessing or using the Elefant toy rental app and related services ("Service"), you agree to be bound by these Terms & Conditions ("Terms").

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract under applicable law.

2. Account Registration

You agree to provide accurate and complete information during registration. You are solely responsible for maintaining the confidentiality of your account credentials and all activities carried out through your account.

3. Membership Plans & Usage

Elefant operates on subscription-based membership plans, each defining:

  • Number of toys allowed at a time
  • Swap frequency
  • Applicable fees

Key points:

  • Users may hold only the number of toys allowed under their active plan at any given time, irrespective of total swaps.
  • Additional toys cannot be dispatched unless an existing toy is initiated for return.
  • Membership benefits are non-transferable and valid only for the registered user.

Elefant reserves the right to modify plan features, pricing, or availability with prior notice.

4. Payments, Refunds & Cancellations

Payments

All toy purchases made through the Elefant app must be paid in full at the time of order placement, including applicable taxes, delivery charges, or add-ons such as damage waiver (if selected).

Refunds

  • Refunds are applicable only for toy purchases and not for memberships, services, or add-ons, unless explicitly stated.
  • A refund request will be accepted only if the toy is returned within 5–7 days from the date of delivery (exact duration as displayed at the time of purchase).
  • The toy must be returned in the same condition as delivered, including:
  • Fully functional and playable state
  • No physical damage
  • No missing parts, accessories, or components
  • Toys failing quality inspection may be rejected for refund or refunded partially at Elefant's discretion.

Approved refunds will be processed to the original payment method, as deemed appropriate by Elefant.

Cancellations

  • Orders may be cancelled only before dispatch.
  • Once a toy has been dispatched or delivered, cancellation is not permitted and the refund policy will apply instead.
5. Rental Period, Swaps & Returns
  • Toys must be returned within the timelines defined by the membership or swap request.
  • Delayed returns may attract late fees or temporary suspension of swaps.
  • Elefant reserves the right to withhold new dispatches until pending returns are completed.
6. Damage, Loss & Missing Parts

Damage Waiver

  • Elefant may offer an optional damage waiver at the time of purchase.
  • If the user has opted for the damage waiver, minor damages caused during normal use may be covered, subject to inspection.
  • If the user has not opted for the damage waiver, they shall be fully liable for the cost of repair or replacement of the damaged toy.

Missing Parts (Strict Policy)

  • Missing parts or components are not covered under the damage waiver.
  • Toys returned with any missing part, accessory, or piece will be considered ineligible for refund or waiver benefits.
  • The user will be liable to pay the full replacement or recovery cost in such cases.

Loss

  • In case of loss or irreparable damage, Elefant reserves the right to charge up to the full MRP of the toy.

Elefant's assessment of damage, loss, or missing parts shall be final and binding.

7. Sell & Buyback Policy

Elefant may offer users the option to sell toys back to Elefant, subject to eligibility.

Buyback Options

Eligible users may choose one of the following:

  1. Direct Payout to original source
  2. Membership Deduction (adjusted against current or future plans)

Condition & Valuation

  • Buyback value depends on the physical condition of the toy upon inspection.
  • To be eligible, the toy must:
  • Be in playable and functional condition
  • Have no missing parts or pieces
  • Not be broken, unsafe, or heavily damaged

Elefant's inspection and valuation decision shall be final and binding. Toys not meeting criteria may be rejected or assigned a reduced value.

8. Sanitisation & Safety Disclaimer
  • All toys are professionally cleaned and sanitised before dispatch.
  • Sanitisation follows industry-standard hygiene processes; however, Elefant does not guarantee a germ-free or allergen-free product.
  • Elefant shall not be liable for any allergic reactions, health issues, or misuse post-delivery.
9. Prohibited Activities

Users must not:

  • Intentionally damage toys
  • Attempt fraudulent returns or buybacks
  • Misuse membership benefits
  • Interfere with app functionality or security
10. Termination & Suspension

Elefant may suspend or terminate accounts without prior notice if:

  • These Terms are violated
  • Payments are overdue
  • Toys are not returned
  • Fraudulent or abusive behavior is detected
11. Limitation of Liability

To the maximum extent permitted by law, Madshades Technologies Pvt. Ltd. shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of data or revenue.

12. Changes to Terms

Elefant may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
